TERMS AND CONDITIONS OF BOAT RENTAL AGREEMENT
These Terms and Conditions (“Agreement”) govern the boat rental services provided by Coast To Coast - Capri Boat Tours by Ferdinando Lentino (the “Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). By making a reservation and/or using our services, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
1. Booking and Payment
1.1 Reservations may be made online through our official website or directly at our office.
1.2 For online bookings, the Customer may either:
Pay the full rental amount by credit card at the time of booking; or
Pay the full amount on the day of the rental, prior to departure, in cash or by credit card.
1.3 The online payments are processed through Stripe LLC.
1.4 The Company reserves the right to request the Customer’s valid credit card details in order to perform a pre-authorization for a reasonable amount, as permitted by applicable law, to secure payment for potential damages, penalties, unpaid balances, or additional costs incurred during the rental period.
1.5 Upon request, the Company will issue a receipt or invoice in accordance with applicable Italian tax regulations.
2. Cancellation and Refund Policy
2.1 Cancellations made at least 24 hours prior to the scheduled rental time are eligible for a full refund.
2.2 Cancellations made less than 24 hours prior to the scheduled rental time will incur a cancellation fee equal to 100% of the total rental price.
2.3 No-shows are non-refundable.
2.4 In the event of unsafe weather conditions, maritime authority restrictions, or other force majeure events beyond the Company’s reasonable control, the Company reserves the right to cancel or reschedule the rental. In such cases, the Customer will be offered either:
A full refund; or
The option to reschedule, subject to availability.
3. Rental Conditions and Use of the Vessel
3.1 The rental includes the vessel, standard safety equipment required by law, and any additional services expressly confirmed at the time of booking.
3.2 Fuel is included in the rental price unless otherwise expressly stated in writing.
3.3 The rental period begins and ends at the times agreed upon in the booking confirmation. Late returns may result in additional charges.
3.4 The maximum passenger capacity established for each vessel must not be exceeded under any circumstances.
3.5 The vessel must be used in compliance with all applicable maritime laws and regulations. The Company reserves the right to terminate the rental without refund if the Customer violates safety regulations or engages in unlawful or dangerous conduct.
4. Liability and Insurance
4.1 The vessel is covered by mandatory insurance in accordance with Italian law.
4.2 The Customer is financially responsible for any damage caused to the vessel, its equipment, third parties, or property during the rental period, except where such damage results solely from a proven mechanical failure not attributable to the Customer.
4.3 The Company shall not be liable for loss of or damage to personal belongings brought on board by the Customer or passengers.
4.4 To the maximum extent permitted by applicable law, the Company shall not be liable for indirect, incidental, or consequential damages arising out of or related to the rental.
5. Customer Obligations
5.1 The Customer and, where applicable, the designated captain are responsible for ensuring that the vessel is operated safely and in compliance with all navigation laws and regulations.
5.2 Operating the vessel under the influence of alcohol, drugs, or any substance that may impair judgment or ability is strictly prohibited.
5.3 The captain is responsible for the safety and conduct of all passengers on board during the rental period.
6. Privacy and Data Protection
Personal data collected in connection with bookings and payments will be processed in accordance with the General Data Protection Regulation (GDPR) and applicable Italian data protection laws. Personal data will not be disclosed to third parties without consent, except where required by law or necessary for the performance of the contract.
7. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Italy.
Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the Court of Naples, Italy, unless otherwise provided by mandatory consumer protection laws.
